To whom it may concern,

I won’t make this letter too long but I do have to let you know my husband and I recently had our car, a 2007 Pontiac Torrent, repossessed by GMAC on May 20th 2009, unknowingly and unfairly, and almost illegally. Also we had a notice that until June 11th we could pay the three months we were in arrears to get our car back before the car was put up for auction to be sold. My husband called the PPS repo center in Manalapan NJ that GMAC customer service and redemption center gave us to contact so we could get our belongings back right away then pay, because we have a baby, we had money in there, I had just put my husband’s clothes in the car that morning to go to the dry cleaners, and my medication was in the glove box, along with the baby seat, her clothes, her shoes etc. I left at least 12 messages over the course of two weeks with PPS to get my belongings back. We also have the certificate of title to the car, free and clear because Pontiac or GMAC messed up on the paper work initially when we changed our lemon car, a g6, to the Pontiac torrent back in September of 2006. I called nonstop to every customer service department I could get a hold of to try and find out why we had the title. Finally I called the dealership where we picked up our car, located In freehold NJ, and the manager there stated after looking over our file that we had in fact done a smart lease initially with the G6 but after it was deemed a lemon, we were offered a buyout option on a new car. We chose the torrent, and the paperwork was finalized. We were told that the payments would continue untouched, only the car would be changed in their system and the financing option. They also sent us a check back for about $1200 which was the difference in price for the two cars.

THE AMENDMENT TO THE CONTRACT YOU SIGNED WAS FOR A FINANCE (A SMART FINANCE) HOWEVER THEY NEVER CHANGED IT IN THE FINANCING DEPARTMENT (NEVER SENT THE PAPERWORK IN). SO THE GMAC HEADQUARTERS DIDN’T EVEN KNOW WE HAD A TORRENT. WE HAVE THE TITLE. EVEN THOUGH THERE IS A LIEN AND WE ARE WILLING TO PAY OFF THE LIEN, THEY ILLEGALLY REPOSSESSED THE CAR, AND NEVER GAVE US ANY NOTICE THAT A PAYMENT HAD TO BE MADE UNTIL THIS SITUATION WAS FIGURED OUT. NEDDY, THE ACCOUNT MANAGER I SPOKE WITH OVER AT GMAC HEADQUARTERS, SAID TO HOLD OFF ON PAYING MORE UNTIL THEY SPOKE WITH PONTIAC IN FREEHOLD AND FIGURED THIS OUT AND RESTRUCTURED OUR PAYMENT PLAN IN THE FINANCING DIVISION.

THIS WAS NEVER DONE. THIS MORNING I RECEIVED A VOICEMAIL FROM A MR. LYNCH STATING THAT I HAD TO CALL HIM BACK BY 3:30 PM EASTERN STANDARD TIME IN ORDER TO HAULT THE REPO, AND TO MAKE GOOD ON THE PAYMENTS THAT WE ARE BEHIND ON, UNTIL THE SITUATION IS RECTIFIED. THEY HAD NO IDEA THE PEOPLE CAME TO PICK UP THE CAR WEN I SPOKE TO MR. LYNCH AT 12:20 PM. I TOLD HIM I HAVE THE TITLE; IT IS ILLEGAL TO REPO A CAR THAT WE OWN. HE AGREED AND HAD SAID Neddy, the account manager had GIVEN SPECIFIC INSTRUCTIONS TO NOT HAVE THE CAR REPOD UNTIL AFTER 3:30 PM EASTERN STANDARD TIME WHICH THEY DIDN’T FOLLOW. He disagrees with neddy’s decision, but at this point he says its out of his hands and we have to g=take legal action, take them to court, and also call the redemption center to show proof we do own the car and to get it back.A couple months later we had received the clear title to the car. I was baffled, called the dealership and they told us they messed up on our paperwork and needed the title back. I kindly obliged, under one condition; send us proof we are financing and not leasing. The reason I asked this was because in January of 2008, I received my monthly GMAC bill in the mail and noticed some terms looked different. I compared it to the last month’s bill, and saw it changed from a finance to a lease, and the monthly payments left went from 18 to 30 something. That’s when I started calling gmac nonstop. No one would help me, and they just kept saying they would have someone call me back.

I told her simply, get me the correct paperwork so we can get this all right and fixed, and ill send you a payment. But get this fixed first. This is so crazy, confusing and upsetting.

Well, Neddy called at least 3 times a day for the next 2 weeks harassing us for a payment…she would not provide anything to us. On May 20th, about a week after speaking with Neddy I was upstairs putting my daughter down for a nap, came downstairs, listened to the voicemail messages and there was one from 8:45 am that morning from a man named “ mr lynch in the resolutions department “ who stated I had to call him back by 3:30 pm eastern standard time asap. I went outside first to get the mail and then I planned on calling him the moment I came back inside. When I walked outside, lo and behold, my car was GONE. I called the police, they told me that Pontiac ordered the repossession, and they faxed a copy to me. Funny thing is….the license plate the repo man was looking for was NOT MY CAR’s license plate; the plate was from my old G6 I leased; the plate I had for MY CAR is for the ONE we own. Wrong license plate you guys have. So how did he pick up a car with incorrect plates? How did he know that was the right car? He couldn’t‼! He ILLEGALLY TOOK MY CAR; HE STOLE IT.

Finally in march 2009 I was so fed up, confused, and had figured it out on paper that I thought we were still paying for a car we already owned free and clear as per the title, and since no one EVER got back to me regarding this whole mess….i stopped making payments. Then someone would pay attention. And yes they did. So finally they started listening to our problems, and forwarded our calls up and up the ladder until it fell in the lap of this lady named Neddy who claimed she was the Vice President’s assistant. She told me that we do not own the car, the title I have means nothing, we still owe about $5,000 to finish up the lease and then we would have to turn it in in November or December….i do not remember which month it was that she told me. I told her, look, I don’t have the new paperwork from when we transferred the lemon g6 to the torrent…can you please forward me the contract so my husband and I can read it and then we will pay again….but we need to know whats really going on! Its not fair to us! She said she didn’t have the paperwork either and that’s why she was calling me. Apparently, according to neddy, she didn’t even have in her system that we had the torrent, and that we gave the g6 back to the dealership in February this past year and still owed $5,000 on the returned vehicle. I lost it after that.
I had my 2 year old’s car seat, all my money in my console hidden, my two prescriptions hidden in there since I had just picked them up from the pharmacy the eveningprior to this incident, and I had about 50 shirt and pants of my husbands that I put in the car that morning to drop off at the dry cleaners after my daughters nap.

Called 1-877-845-8862 THIS IS THE REDEMPTION CENTER TO GET OUR CAR OUT OF REPOSESSION, EXPLAIN THAT PONTIAC DEALERSHP MADE A HUGE ERROR AND SENT US THE TITLE BEFORE HAVING US PAY THIS OFF. THEY HAVE NO PAPERWORK AT FREEHOLD PONTIAC SHOWING WE EVEN HAVE THE PONTIAC TORRENT. THEY SHOW WE HAD THE G6, AND TURNED IT IN.

So I went back and forth with the redemption department. I sent them a copy of my free and clear title. No liens, no one on there but BRADLEY C. Galen, my husband. They ignored me. Then I got a letter in the mail stating we had until May 31st to go to PPP to pay the money owed which was approximately $1400 to get our car back before it went to auction. We went to PPP May 26th to pay….but…..the car was gone. Already sent to the auction in Maryland. And our money in the car was gone our prescriptions were gone and so were half of our clothes. We called Manalapan police and they took our report. So did Marlboro twp police regarding the car being stolen from us. This is all going to court soon.

We want our car back. I lost my job due to this because I still have no transportation. I have a 2 ½ yr old daughter who I cant drive anywhere unless I rent a car or borrow one because our credit is ruined now that a repossession is on our report. Brad Galen had 3 Pontiacs in the last 5 yrs, always paid on time, was a loyal customer and this is the way it ended. We need this resolved. If I have to bring it to the courts again and let the news stations know, the bbb and shame on you I will but I don’t want to go that far because I am not the type of person to seek revenge. But in this case we were taken advantage of, left to rot.

If you have any conscience or feelings at all you will make this right, and look at the attached Clear Title and purchase agreement of the Pontiac torrent we have. I have attached it for you.
